Bio Concepts Pty Ltd ACN 010 516 775 ("Bio Concepts", "we" or "us") recognises and values the protection of your Personal Information. We use reasonable steps to ensure that all Personal Information is handled sensitively and securely. Bio Concepts is committed to complying with its legal obligations including the Privacy Act 1988 (Cth) ("Act") and the Australian Privacy Principals (“APPs”).

Throughout this Privacy Policy, we use the term “Personal Information” to describe any data that personally identifies you or makes you personally identified, which has the meaning set out in the Act.

This Privacy Policy outlines what information we collect and store, why we need to collect and store Personal Information, how we collect, use, store and disclose Personal Information, who we may share that information with, and how you may access and/or correct Personal Information that we keep.

Personal Information we collect from you

So that we can provide goods and services to you, we may collect Personal Information such as your name, images of you, gender, your preferences, address, telephone number, email address, bank account or credit card details and any additional information provided directly by you via our forms, which may include health information if disclosed by a practitioner. We may not be able to supply the requested goods and services to you if you do not provide the information requested. Under no circumstances will we request or collect any information about your religious orientation, sexual orientation, or political affiliations.

At times we may request or collect sensitive information from you, including:

a)   health information;

b)   educational and qualification information;

c)    professional or trade association membership information (e.g., NHAA, ANTA, ATMS APHRA); or

d)   ethnic origins.

In circumstances where we do require sensitive information from you for the purpose of providing our focussed services to you, we will seek your consent to collect it unless the information has been provided to us by a practitioner who holds an account with us. 

We will only use or disclose sensitive information for the primary purpose for which it was collected or for a directly related secondary purpose that would have been within your reasonable expectations at the time we collected the information from you.

If you are a practitioner who holds an account with us and you disclose sensitive information to us in relation to a person, you warrant that you have received consent from the person to disclose their sensitive information to us. You agree to indemnify and hold harmless Bio Concepts against any claim, demand, action or proceeding made by any person arising from or in connection with the disclosure of that person’s personal or sensitive information to us.

How we may collect information

Bio Concepts may collect Personal Information from time to time, when we request it from you, or when you authorise others to provide it to us, including:

a) directly from you;

b) through one of our authorised distributors or health professionals;

c) when you register as a member or for access through our website;

d) when you place an order, subscribe or otherwise engage with our services via our website or directly through us;

e) where you access and interact with the website or one of our employees;

f) when you contact us by email, telephone or other means; and

g) when you register for one of our educational seminars.

We may also collect your Personal Information while conducting surveys or market research and we may seek other additional information from you. These surveys will provide us with information that will help us make improvements to the type and quality of goods and services that we offer you.

Use and disclosure of Personal Information

We use your Personal Information to provide goods and services to you. We may also use your Personal Information to advise you of new products and services, and to assist you in any way in which you request assistance. Examples of our use of your Personal Information include:

a) for a business or professional relationship, we have with you;

b) processing applications or requests for our products and services, managing those products and services and other relationships and arrangements;

c) providing you with marketing communications such as emails, newsletters and alerts, surveys and invitations and offers for our products and services (you have the option to opt-out of these communications at any time);

d) for marketing, market research and business development, including on social media platforms;

e) for internal accounting and administration purposes;

f) to seek your feedback in relation to customer satisfaction with our products and our relationship with you;

g) dealing with complaints; and

h) any purpose as required by various Australian laws which may either expressly, or in effect, require us to collect your Personal Information. Such laws include the Commonwealth Taxation Administration Act, Income Tax Assessment Act and other taxation laws (for example, to comply with information requests issued by the Federal Commissioner of Taxation) and laws relating to the products and services we provide such as those contained in the Therapeutic Goods Act.

You have the right to tell us that you do not want us to send information to you other than for the main purpose for which we have collected your Personal Information.

Unless you give us your consent to do so, Bio Concepts will not sell, distribute, rent, license, disclose, share or pass your Personal Information to any other party, other than:

a) third parties who have contracted with us to keep that information confidential (whether or not the party is subject to a statute or a scheme which imposes similar restrictions to the Australian Privacy Principles contained in the Act regarding handling of Personal Information); or

b) as otherwise required by law.

Storage of Personal Information

We have implemented appropriate technical and organisational security measures to help safeguard your Personal Data, help prevent unauthorised access, unauthorised interference, help maintain data security and to limit use of your Personal Data to what is allowed by this Privacy Policy. We have implemented technology and security policies, rules, and other reasonable steps to protect your Personal Data from loss, modification, unauthorised access, unauthorised interference, improper use, improper alteration, unlawful or accidental destruction, or accidental loss.

Keeping records

Should any of the personal details and information we collect from you change in any way, it is your responsibility to advise us of that change so that our records can be updated and continue to be of service to you.

We store your Personal Information as long as we consider necessary for the purposes set out in this Privacy Policy or for audit, regulatory or record keeping purposes. We will delete our copy of you Personal Data seven (7) years from the end of any contract we have with you, or when we are no longer required by law to retain it, whichever is later. However, we may maintain record of contact with you for longer if required by law.

 Your Personal Data may be stored in electronic form or hard copy. Personal Data is encrypted by our third party data hosting providers.

Transfer of your Personal Information overseas

We will only transfer your Personal Information overseas if the transfer is to you, or to one of your authorised representatives, or with your express consent, or the transfer is necessary for the provision of contracted products or services to you. We will not send your Personal Information outside of Australia in any other circumstances. Where we have sent your Personal Information overseas, we will use reasonable endeavours to ensure that your Personal Information is protected by principles consistent with those contained in our privacy policy and the Australian Privacy Principles contained in the Act.

Our websites may contain links to other Bio Concepts or third-party websites, which may have privacy & cookie notices that differ from ours. We are not responsible for the collection, processing or disclosure of personal information collected through such other websites.

We are also not responsible for any information or content contained on such websites. Links to other websites are provided solely for convenience. Your usage and browsing on any such website is subject to that website’s policies. Please review the privacy policies posted on other websites that you may access through our website.

Cookies & Web Beacons

We may use cookies on our website from time to time. Cookies in and of themselves do not provide us with Personal Information, however if you provide your Personal Information on our website, we may gather information that is linked to data stored in the cookie.

We may use web beacons from time to time. This will monitor behaviour such as counting user visits, or deliver a cookie to the browser of a visitor viewing our website. Cookies may also collect information to analyse personal browsing behaviour, remember user preferences, personalise our Services, and to deliver and measure advertising

These tools may enable third parties to cause advertising to appear on your social media and online feeds.

Correction of Personal Information

If you believe that the Personal Information that we hold in relation to you is inaccurate, not up to date or incomplete, you may ask us to alter that Personal Information and we will do so unless we reasonably believe that the Personal Information is accurate, up to date and complete. If we do not agree to alter that Personal Information, we will allow you to provide a statement as to why you believe that Personal Information is inaccurate, not up to date or incomplete and we will keep that statement with your Personal Information.

Privacy complaints or disputes

If you believe that we have breached our privacy reporting obligations under the Act, or you are unsatisfied with the manner in which we have dealt with your Personal Information, you may make a complaint by emailing us at:

As part of providing goods and services to you we may at times send you marketing and promotional material. You may opt-out from receiving this material by following the instructions contained within the email or included in each communication we send to you.

We may need to change our privacy policy from time to time

Due to changing business circumstances or legislative changes, we may need to change our privacy policy from time to time. If we change our privacy policy the changes to the policy will comply with the Act and we will endeavour to ensure that your overall level of privacy protection is not diminished, and we will publish those changes on our website. You are encouraged to check our website regularly to consider, and act on, any changes to our privacy policy. We reserve the right to change our privacy policy without notice to you.
